Terms of Service

1. Acceptance of Terms

By accessing or using SkyShare ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

SkyShare is a platform that allows users to share photographs of the sky from various locations around the world, along with comments and geographical information.

3. User Accounts

To use certain features of the Service, you must register for an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

When creating an account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure.

4. User Content

Users may post content, including photographs, comments, and location information ("User Content"). You retain all rights to your User Content, but you grant SkyShare a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, and distribute your User Content for the purpose of displaying, distributing, and promoting the Service.

You represent and warrant that:

  • You own the content posted by you on or through the Service or otherwise have the right to grant the rights and licenses set forth in these Terms.
  • The posting and use of your User Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person.

5. Prohibited Content

The following types of content are prohibited on SkyShare:

  • Content that is illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, or hateful.
  • Content that you do not have a right to make available under any law or under contractual relationships.
  • Content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
  • Unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.
  • Material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware.

We reserve the right to remove any content that violates these terms or is otherwise objectionable at our sole discretion.

6. Privacy

Please review our Privacy Policy, which also governs your use of the Service and explains how we collect, use, and disclose information that pertains to your privacy.

7. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms.

You may delete your account at any time through the settings page. Upon termination, your right to use the Service will immediately cease.

8. Service Modification and Termination

The owner of SkyShare reserves the absolute right to:

  • Modify, suspend, or discontinue the Service (or any part or content thereof) at any time without notice or liability
  • Restrict access to some or all features to any user, at any time, in the owner's sole discretion
  • Terminate your account and remove your content without prior notice if your use violates these Terms
  • Transfer ownership of the Service to another entity without user consent
  • Change the Terms of Service at any time

By using this Service, you acknowledge that the owner may exercise these rights without obligation to notify users or provide compensation. Users have no ownership rights to any aspect of the Service.

9. Data Rights

While you retain copyright ownership of your User Content, you grant the owner of SkyShare perpetual, worldwide rights to:

  • Store, copy, modify, create derivative works, and publicly display your content
  • Use your content for any purpose, including commercial purposes
  • Retain your content for backup purposes even after account termination
  • Feature your content in promotional materials without compensation

The owner may delete your content at any time for any reason, including after account termination, with no obligation to provide copies to you.

10. Limitation of Liability

In no event shall SkyShare, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service;
  • Any conduct or content of any third party on the Service;
  • Any content obtained from the Service; and
  • Unauthorized access, use or alteration of your transmissions or content.

11. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
